PrizePicks locks in agreement with former head of social over trade secrets

The case of Judah Huffman’s switch from PrizePicks to DraftKings will not include a prolonged legal process like the case between Fanatics VIP head Michael Hermalyn and DraftKings did.

Instead, PrizePicks has voluntarily dropped the case with prejudice before Huffman even filed a response.

PrizePicks and Huffman reach agreement with conditions

Earlier this month, PrizePicks and Huffman informed the Western Washington District Court that, though Huffman disputes the allegations, the parties reached an agreement regarding the trade secrets the company said Huffman took when he left the organization.

In the initial suit, PrizePicks said Huffman left his post as head of social for the fantasy sports company and did not inform the company he was taking a similar post with DraftKings. The complaint alleged that Huffman used AI to obtain a number of confidential PrizePicks documents, including his non-compete agreement. According the PrizePicks, Huffman uploaded the agreement to ChatGPT and asked the AI tool to analyze it for enforceability.

PrizePicks also alleged that Huffman received a revised salary offer of $210,000 a year which the company believes came from his willingness to share protected information.

Terms of deal include removal of material from ChatGPT

As part of the agreement, Huffman has agreed to the following terms:

  • He will not use or disclose information from the PrizePicks Brand Planning document
  • He will not use or disclose information from the PrizePicks Team Goals document
  • He will not utilize or disclose any other proprietary information he was privy to during his tenure with PrizePicks
  • He will not destroy any additional work documents in his personal possession
  • He will remove all of PrizePicks trade secrets from his ChatGPT account

Does Huffman still work at DraftKings?

Huffman’s LinkedIn profile previously included a new role as DraftKings director of social and community (sportsbook). That entry has been removed from his profile, as has any mention on his personal social media regarding a position with DraftKings.

“Huffman has complied with the non-competition agreement, and the matter has been resolved,” PrizePicks spokesperson Elisa Richardson confirmed to SBC Americas.

SBC Americas reached out to DraftKings for comment on this story but has yet to receive a response.
