Evolution is giving its lawsuit against Light & Wonder another go. The game studio has filed an amended complaint in Nevada District Court alleging that there is a third game Light & Wonder is infringing upon.
Evolution’s initial lawsuit centered around Lightning Roulette and its claim that Light & Wonder’s Roulette X product is infringing upon Evolution’s patents. The lawsuit also claimed that Light & Wonder and Evolution initially had a partnership to develop Lightning Roulette for a brick and mortar setting only for it to fall apart in advance of Light & Wonder rolling out Roulette X.
In February Nevada District Court Judge Cristina Silva dismissed the lawsuit, explaining she did not believe the patents around the Lightning Roulette game were too vague to be enforceable and fail the Alice test.
In the new suit, Evolution has refined its argument around its patents, trying to address the concerns raised in Silva’s ruling. IT also added 88 Fortunes Blaze Live Roulette to its list of games they feel utilize Evolution patents. Light & Wonder previewed the game at the 2024 Global Gaming Expo and launched it back in January.
Evolution sent a letter threatening further legal action to Light & Wonder in February, then added its concerns about the game, which is said to be operational at at least two live dealer studios, one in the U.S. and one in Europe.
Evolution is seeking a judgment preventing Light & Wonder from offering these games, treble damages and disgorgement of profits Light & Wonder obtained from offering the games in question.
In her motion dismissing the case, Silva allowed Evolution to amend its complaint but did express doubts about their success given the failures she found in the enforcability of Evolution’s patents.
In the meantime, Light & Wonder announced in February that it would be folding its live dealer unit, which is where the new 88 Fortunes Blaze Live Roulette debuted.
Light & Wonder declined to comment on this story, as it has a policy of not commenting on active litigation.
